Definitions

Company:means Jsons Digisoft Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at Plot No.-16, Ganesh Nagar, Shankar Vihar Extension, Jamna Puri, Jaipur, Rajasthan 302039.

Platform: means Techniqq, including all associated software platforms, SaaS products, mobile applications, websites, APIs, integrations, dashboards, and related digital services provided by the Company.

Services:means all software, subscriptions, licenses, integrations, support services, and digital solutions offered through the Platform.

Subscription:means any paid plan, license, or recurring service purchased by a Customer.

Customer” / “User:means any individual, company, or entity using or subscribing to the Platform.

Order:means a request to purchase or subscribe to Services on the Platform.

Business Days:means days excluding Sundays and public holidays.

Force Majeure Event:means events beyond reasonable control as defined under Clause 15.

Headings are for convenience only and shall not affect interpretation.

Applicability and Binding Nature

  • This Cancellation Policy (“Policy”) applies to all purchases, subscriptions, and service engagements made on the Platform.
  • By subscribing to or using the Services, the Customer agrees to be bound by this Policy.
  • This Policy forms an integral part of the Terms and Conditions governing the use of Techniqq.

General Principles Governing Cancellation

Cancellation rights are limited and depend on:

  • the nature of the service or subscription,
  • activation or usage status
  • contract duration,
  • compliance with this Policy.
The Company reserves the right to approve or reject cancellation requests at its sole discretion, acting reasonably and in good faith.
System logs and timestamps maintained by the Platform shall be final for determining eligibility.

Service Lifecycle and Cancellation Stages

Before Activation / Provisioning

  • Cancellation permitted without penalty.
  • Eligible for full refund (subject to Clause 11).

After Activation but Before Usage

  • Cancellation may be permitted.
  • Setup, onboarding, or administrative charges may be deducted.

After Partial Usage

  • Cancellation allowed at Company’s discretion.
  • Charges will be prorated or partially deducted.

After Full Activation / Active Subscription

  • Cancellation does not entitle refund unless explicitly stated.
  • Service continues until the end of the billing cycle.

Auto-Renewal Subscriptions

  • Must be cancelled before the renewal date.
  • No refunds for renewed billing cycles once processed.

Mode of Cancellation

Cancellation requests must be made through:

  • the User dashboard on the Platform, or
  • official support channels of the Company.
Requests made via informal or unauthorized channels shall not be considered valid

Partial Cancellation

Customers may cancel specific modules, add-ons, or integrations where technically feasible.

Bundled or enterprise packages must be cancelled as a whole unless otherwise agreed in writing.

Non-Cancellable Services

Unless required by applicable law, cancellation shall not be permitted for:

  • Activated software licenses or subscriptions;
  • Custom-developed or configured solutions;
  • API usage once credentials are issued;
  • Digital services already accessed or consumed;
  • Setup, onboarding, or implementation services already delivered;
  • Third-party integrations once provisioned;
  • Promotional or discounted plans marked as non-cancellable;
  • One-time service fees (e.g., installation, customization);
  • Enterprise contracts with minimum lock-in periods.

Cancellation by the Company

The Company reserves the right to cancel or suspend Services without liability due to:

  • Violation of Terms of Service;
  • Non-payment or chargebacks;
  • Fraudulent or suspicious activity;
  • Technical or security risks;
  • Legal or regulatory requirements;
  • Service discontinuation;
  • Force Majeure Events.

Refund Framework

Refund Eligibility

  • Refunds are applicable only where cancellation is approved under this Policy.

Refund Timeline

  • Refunds will be initiated within 7–15 business days from approval, subject to banking timelines.

Taxation

  • All refunds will comply with applicable tax laws in India.
  • Taxes once remitted may not be refundable.
  • Credit notes may be issued where required.

Children’s Privacy

The Company shall not be liable for delays or failures caused by events beyond reasonable control, including:

  • natural disasters
  • cyber incidents,
  • government restrictions,
  • infrastructure or network failures.
